İşveren ile yapılan bir iş sözleşmesine bağlı olarak çalışan işçi arasında çalışma ortamını ve şartlarını ve bunlara ilişkin hak ve yükümlülükleri iş kanunu düzenler.
Kanuna göre işçi, bir ücret karşılığında işverene hizmet sözleşmesi ile bağlanan kişidir ama iş kanununun 4.maddesi bir istisna teşkil ederek kimin işçi statüsüne girmediği konusunu listelemiş durumdadır.
